However, <strong>France<\/strong> appears to be deviating from this approach, threatening to <strong>block access to its market<\/strong> for certain <a href=\"https:\/\/investx.fr\/en\/crypto-investing\/\">crypto<\/a> companies despite their authorization elsewhere in the EU.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"fr\" dir=\"ltr\">\ud83c\uddeb\ud83c\uddf7 \ud83c\uddea\ud83c\uddfa La France menace de bloquer certaines entreprises crypto d\u2019op\u00e9rer sur son territoire, afin de pousser \u00e0 un transfert de leur supervision vers l\u2019ESMA Autorit\u00e9 europ\u00e9enne des march\u00e9s financiers.<br><br>L&#39;AMF serait pr\u00e9occup\u00e9 par le fait que, dans le cadre du nouveau r\u00e9gime\u2026 <a href=\"https:\/\/t.co\/FFlTdaG0mE\">pic.twitter.com\/FFlTdaG0mE<\/a><\/p>&mdash; Goku \ud83d\uddde (@Crypto__Goku) <a href=\"https:\/\/twitter.com\/Crypto__Goku\/status\/1967810616913015231?ref_src=twsrc%5Etfw\">September 16, 2025<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p><strong>Marie-Anne Barbat-Layani<\/strong>, president of the French Financial Markets Authority (<strong>AMF<\/strong>), the country&#8217;s financial watchdog, recently spoke on this issue. According to her, the &#8220;European passport&#8221; system provided by MiCA could encourage crypto players to gravitate toward countries with the least stringent licensing standards.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;We do not exclude refusing EU passporting. Legally, it&#8217;s very complex and not a good signal for the internal market [&#8230;] But it&#8217;s a possibility that we&#8217;re keeping open,&#8221; she told Reuters.<\/p>\n<\/blockquote>\n\n\n\n<p>The AMF therefore fears a form of <strong>&#8220;regulatory arbitrage&#8221;<\/strong>, where companies would seek to establish themselves in countries offering the most favorable framework, potentially circumventing French requirements. This position challenges one of the key principles of MiCA.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"potential-blocking-of-specific-licenses\">Potential Blocking of Specific Licenses<\/h2>\n\n\n\n<p>Although the AMF has not specified which licenses it might target, this blocking threat raises numerous questions. Which companies would be affected ? Barbat-Layani describes this potential &#8220;nuclear weapon&#8221; as a <strong>&#8220;pressure tactic&#8221;<\/strong> against what she considers &#8220;loopholes&#8221; in the MiCA licensing system.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"a-negative-signal-for-crypto-adoption-in-france\">A Negative Signal for Crypto Adoption in France ?<\/h2>\n\n\n\n<p>By questioning the European passport, France is engaging in a <strong>regulatory arm-wrestling match<\/strong> that could <strong>undermine the confidence<\/strong> of investors and companies in the French crypto ecosystem. This sends a discouraging signal for the widespread adoption of digital assets in France.<\/p>\n\n\n\n<p>While MiCA was supposed to offer <strong>a clear and stable framework<\/strong> for industry development, these <strong>tensions<\/strong> highlight the persistent challenges in crypto regulation at the European level.
