America’s futures markets regulator has no intention of being left behind by the crypto revolution. Mike Selig<\/strong>, chair of the CFTC<\/strong>, has just laid the groundwork for a sweeping regulatory overhaul \u2014 one designed for markets that never sleep.<\/p>\n\n\n\n

As the Clarity Act<\/strong> \u2014 the landmark crypto clarification bill \u2014 has stalled in Congress, the CFTC<\/strong> is pressing ahead on its own. It’s an assertive stance that is fundamentally reshaping the relationship between regulation and blockchain innovation.<\/p>\n\n\n\n

This strategic shift raises a central question: are traditional regulators genuinely ready to oversee markets driven by algorithms<\/strong> and agentic finance<\/strong>, running continuously, without intermediaries?<\/p>\n\n\n\n

Selig and the markets of tomorrow: algorithms, on-chain infrastructure, and agentic finance<\/h2>\n\n\n\n

Speaking on CNBC<\/strong> this Wednesday, Mike Selig<\/strong> clearly identified the shift toward “24\/7, on-chain” markets<\/strong> as the CFTC’s top regulatory priority. In his view, the entire existing rulebook needs to be reassessed in light of this new reality: automated markets operating around the clock, free from the friction that characterizes traditional financial venues.<\/p>\n\n\n\n

The term “agentic finance”<\/strong> he uses deserves attention. It refers to financial systems in which autonomous agents<\/strong> \u2014 typically AI systems or smart contracts<\/a><\/strong> \u2014 execute decisions without direct human intervention. This is no longer science fiction: DeFi<\/a><\/strong> protocols such as Uniswap<\/a><\/strong> and on-chain algorithmic trading platforms already operate on exactly this logic. The CFTC is now officially acknowledging that its current regulatory framework is not calibrated for this type of infrastructure.<\/strong><\/p>\n\n\n\n

A former chief legal counsel to the SEC<\/strong>‘s Crypto Task Force<\/strong>, Selig<\/strong> has been described by David Sacks<\/strong> \u2014 the White House’s crypto and AI czar \u2014 as a “pivotal figure in advancing the president’s crypto agenda.” That political positioning gives him a dual form of authority: technical and institutional. Last week, the CFTC<\/strong> formally submitted a regulatory proposal to the White House<\/strong> to govern crypto transactions and markets.<\/p>\n\n\n\n

The collapse of the Clarity Act<\/strong> in Congress could have paralyzed the entire U.S. crypto regulatory agenda. The bill was an ambitious attempt to draw clear jurisdictional lines between the CFTC and the SEC<\/strong>, by classifying each digital asset \u2014 security<\/strong>, commodity<\/strong>, or stablecoin<\/a><\/strong> \u2014 into a defined category. But banking industry lobbying, opposed to stablecoin yield provisions, combined with ethical concerns from several Democratic lawmakers over the Trump family’s financial interests in the sector, derailed the legislation.<\/p>\n\n\n\n

The result: neither the CFTC<\/strong> nor the SEC<\/strong> waited around. The SEC approved the trading of tokenized equities<\/strong> that same week and published its own framework for crypto asset offerings in August. The CFTC<\/strong>, meanwhile, is advancing its own regulatory proposal. Both regulators are moving in parallel, without waiting for a legislative green light \u2014 a risky strategy, but one that speaks to the urgency they perceive.<\/p>\n\n\n\n

Trump<\/strong> himself has urged lawmakers to pass the Clarity Act<\/strong>, calling it a “very, very powerful” piece of legislation. But as long as Congress remains gridlocked, the administrative regulatory route is the only path forward. For crypto market participants, this transitional period creates a grey area: the rules are evolving, but without the legislative foundation that would give them lasting stability.<\/p>\n\n\n\n

What this shift means in practice for crypto markets<\/h2>\n\n\n\n

Selig’s announcement sends a clear signal to decentralized market operators, DeFi<\/a><\/strong> protocol developers, and stablecoin<\/strong> issuers: the CFTC intends to extend its jurisdiction across the on-chain ecosystem<\/strong>, including automated mechanisms. That potentially covers DEXs<\/strong>, liquidity pools<\/strong>, and algorithmic trading systems running on public blockchains.<\/p>\n\n\n\n

For institutional investors<\/strong>, this signal is paradoxically reassuring: clear regulation<\/a> \u2014 even if demanding \u2014 reduces the legal uncertainty that continues to hold back significant allocations into digital assets. The prospect of regulated crypto markets operating 24\/7 under defined rules structurally brings DeFi<\/strong> closer to the standards expected by major asset managers.<\/p>\n\n\n\n

One major unknown remains: how do you regulate decentralized protocols with no identifiable legal entity?<\/strong> That is the Gordian knot that neither the CFTC<\/strong> nor the SEC<\/strong> has yet cut. The answer to that question will largely define the future of decentralized finance<\/strong> in the United States \u2014 and, by extension, across the globe.<\/p>\n\n\n\n
